1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Player", "User", "you") and phginto ("phginto", "we", "us", "our"), the operator of the online gaming platform accessible at phginto.app ("Platform"). By accessing, registering on, or using the phginto Platform in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety, together with our Privacy Policy and Responsible Gaming Policy, each of which is incorporated herein by reference.

If you do not agree to these Terms, you must immediately cease using the phginto Platform. phginto reserves the right to modify these Terms at any time. Continued use of the Platform following the posting of revised Terms constitutes your acceptance of those changes.

2. Eligibility

To register and use the phginto Platform, you must satisfy all of the following eligibility requirements:

• You must be at least 21 years of age, as required under Philippine gambling regulations. phginto strictly enforces this age requirement and will request documentary proof of age at any time.
• You must be a natural person with full legal capacity to enter into binding contracts under Philippine law.
• You must not be a resident of, or accessing the Platform from, any jurisdiction where online gambling is prohibited by applicable law.
• You must not be a current employee, contractor, director, or officer of phginto, or an immediate family member of any such person.
• You must not have been previously excluded or banned from the phginto Platform or any affiliated platform.

phginto reserves the right to verify your eligibility at any time and to suspend or close your account if you are found to be ineligible. Any winnings accrued during a period of ineligibility may be forfeited.

3. Account Registration

To access the full features of the phginto Platform, you must create a registered account. When registering, you agree to:

• Provide accurate, current, and complete information, including your full legal name, date of birth, Philippine mobile number, and valid email address.
• Maintain and promptly update your account information to keep it accurate and complete.
• Create only one (1) account per person. Multiple accounts are strictly prohibited. If phginto discovers that you hold more than one account, all accounts may be suspended and any balances forfeited.
• Keep your login credentials confidential. You are solely responsible for all activity that occurs under your account. phginto will not be liable for any loss resulting from unauthorised use of your account credentials.
• Notify phginto immediately at [email protected] if you suspect any unauthorised access to your account.

phginto may require you to complete identity verification ("KYC") before processing withdrawals or at any other time. KYC documents may include a government-issued photo ID (e.g., Philippine passport, SSS ID, PhilSys ID, driver's licence), proof of address, and proof of payment method ownership.

4. Deposits and Withdrawals

phginto supports a range of Philippine payment methods including GCash, PayMaya, BPI, BDO, and Metrobank. All transactions are denominated in Philippine Peso (PHP / ₱) unless otherwise stated.

• Deposits: Deposits are credited to your phginto account promptly upon confirmation from the payment provider. Minimum and maximum deposit amounts are displayed on the cashier page and may vary by payment method.
• Withdrawals: Withdrawal requests are processed subject to completion of KYC verification. phginto targets a processing time of 15 minutes for GCash withdrawals, though actual times may vary. Withdrawals must be made to a payment method registered in your own name.
• Currency: All account balances, deposits, and withdrawals are in Philippine Peso (PHP). phginto is not responsible for any currency conversion fees charged by your bank or payment provider.
• Fraud Prevention: phginto reserves the right to delay or withhold withdrawals pending fraud or money laundering investigations. Any funds identified as proceeds of fraud or illegal activity will be reported to the appropriate Philippine authorities.

5. Bonuses and Promotions

phginto offers various bonuses and promotions to eligible players. All bonuses are subject to the following general conditions, as well as any specific terms attached to each individual promotion:

• Bonuses are available to eligible registered players only. phginto reserves the right to determine eligibility at its sole discretion.
• All bonuses are subject to wagering requirements, which must be met before bonus funds or associated winnings can be withdrawn. Wagering requirements are stated in the specific promotion terms.
• Bonuses may not be transferred, sold, or exchanged for cash except as expressly permitted by phginto.
• phginto reserves the right to withdraw, modify, or cancel any bonus or promotion at any time without prior notice.
• Any attempt to abuse bonuses, including through multi-accounting, collusion, or exploitation of software errors, will result in immediate account suspension and forfeiture of all bonus funds and associated winnings.

6. Gameplay Rules

All games available on the phginto Platform are governed by individual game rules, which are accessible within each game. In addition, the following general gameplay rules apply:

• All game outcomes are determined by certified Random Number Generator (RNG) technology or, in the case of live dealer games, by physical game outcomes conducted by trained dealers in a controlled studio environment.
• phginto's decision on the outcome of any game is final and binding, subject to the dispute resolution process set out in these Terms.
• In the event of a technical malfunction during gameplay, phginto reserves the right to void the affected round and return the wager to the player's account. phginto is not liable for any losses arising from technical malfunctions beyond its reasonable control.
• Players are responsible for ensuring they have a stable internet connection. phginto is not responsible for losses resulting from disconnection during gameplay.

7. Prohibited Conduct

The following conduct is strictly prohibited on the phginto Platform. Violation of any of these prohibitions may result in immediate account suspension, forfeiture of funds, and referral to law enforcement authorities:

• Using the Platform for any unlawful purpose, including money laundering, fraud, or financing of illegal activities.
• Attempting to hack, reverse-engineer, or otherwise interfere with the Platform's software, systems, or security measures.
• Using automated software, bots, scripts, or any other artificial means to interact with the Platform.
• Colluding with other players to gain an unfair advantage in any game.
• Providing false or misleading information during registration or KYC verification.
• Allowing any third party to access or use your phginto account.
• Engaging in any conduct that phginto, in its sole discretion, considers harmful to the integrity of the Platform or to other players.

8. Intellectual Property

All content on the phginto Platform, including but not limited to software, text, graphics, logos, game assets, audio, and video, is the property of phginto or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial entertainment purposes only. You may not reproduce, distribute, modify, create derivative works of, or commercially exploit any content from the phginto Platform without prior written consent from phginto.

9. Limitation of Liability

To the maximum extent permitted by applicable Philippine law, phginto's total liability to you for any claim arising out of or in connection with these Terms or your use of the Platform shall not exceed the total amount deposited by you into your phginto account in the thirty (30) days preceding the event giving rise to the claim.

phginto shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or loss of goodwill, arising out of or in connection with your use of the Platform, even if phginto has been advised of the possibility of such damages.

Nothing in these Terms shall limit or exclude phginto's liability for death or personal injury caused by its negligence, fraud, or any other liability that cannot be excluded under Philippine law.

10. Responsible Gaming

phginto is committed to promoting responsible gaming. We provide a range of tools to help players manage their gambling activity, including deposit limits, session time limits, reality checks, cooling-off periods, and self-exclusion. These tools are accessible from your account settings at any time.

11. Account Suspension and Termination

phginto reserves the right to suspend, restrict, or permanently close your account at any time, with or without prior notice, if:

• You breach any provision of these Terms.
• phginto suspects fraudulent, illegal, or abusive activity on your account.
• You fail to complete KYC verification within the required timeframe.
• You request self-exclusion under phginto's Responsible Gaming policy.
• phginto is required to do so by applicable law or regulatory authority.

Upon account closure, any verified real-money balance (excluding bonus funds subject to incomplete wagering requirements) will be returned to you via your registered payment method, subject to phginto's fraud and AML checks.

12. Privacy

phginto collects, processes, and stores your personal data in accordance with our Privacy Policy, which forms part of these Terms. 13. Amendments to These Terms

The revised Terms will take effect on the date specified in the notice. Your continued use of the Platform after the effective date constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must close your account before the effective date.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms or your use of the phginto Platform shall first be submitted to phginto's internal complaints process by contacting [email protected]. phginto will endeavour to resolve all complaints within fourteen (14) business days. If a dispute cannot be resolved through the internal process, it may be referred to the appropriate Philippine regulatory authority or submitted to the courts of the Philippines.
